1. General Terms

The following General Terms and Conditions (GTC) apply to all business relationships between the Tarot Reader ´The Bee Priestess´ and the respective customer. If the Tarot Reader and the customer make individual contractual agreements that deviate from these General Terms and Conditions, the individual contractual regulations take precedence. A business relationship within the meaning of these General Terms and Conditions can be established via the contact form on The Bee Priestess' website or through purchase of a Reading through the Online Shop. These terms and conditions apply exclusively. Differing, conflicting or supplementary general terms and conditions of a customer will only become part of the contract if and to the extent that The Bee Priestess has expressly agreed to their validity in writing. The customer can be either a private individual or a company. Regardless of the definition as a customer, the use of any of the Tarot Readers services requires that the person has full legal capacity. Otherwise, written consent from your legal, arbitrary or court-appointed representative is required.

2.  Contractual Relationship

The subject of the contract between the Tarot Reader and the respective customer is an individual and personal Tarot Reading. The services presented by The Bee Priestess on the Internet - be it on her own website, in social media or other advertising media - and/or through other media do not constitute a legally binding offer to conclude a contract. The customer can submit a request to the Tarot Reader via email or through the Online Shop the website. After receiving payment, The Bee Priestess will provide the customer with a Video Download link to the personal tarot reading. The Tarot Reader is entitled to additionally use the help of third parties to provide her contractual services.

3. Obligations to cooperate/inform

The parties are mutually obliged to provide the other contracting party with all information that is necessary for the timely, proper and optimal provision of the contractually agreed services as early and comprehensively as possible. The contractual partners will also support each other to the best of their knowledge and belief in order to ensure the best possible execution of the contract. The customer agrees to provide the Tarot Reader with an email, a name, and the permission and consent to the services.

4. Prices and payment terms

The Tarot Reader only provides highly personal, individual and creative services. The Prices for the different Readings availabe are listed in the Online Shop. The payment is due immediately. A Reading will only be done and sent to the customer, once payment has been recieved. The Tarot Reader reserves the right to refund a payment. A Refund for the customer is only acceptable and possible if the customer has not already recieved their reading. Once the customer has recieved their reading in digital video form, per email, a refund will not be possible.

5. Rights of use and exploitation

If The Bee Priestess provides the customer with any work samples (videos, photos, graphics, portfolios, presentations, etc.) in connection with the initiation and/or implementation of a contractual relationship - regardless of their form, content and design - this does not constitute a transfer of any rights of use or use Exploitation rights associated. The transfer is made exclusively for the purpose of illustration and for personal inspection by the customer and people associated with them. The work samples may not be reproduced, used, published or left to third parties in whole or in part. The Tarot Reader agrees that all Readings are handled with discretion, are individual and personal and will not be shown to other customers or third parties. The Tarot Reader will not grant third parties any rights to such videos and will counteract any misuse within the scope of her factual possibilities and her legal obligations. The Video Readings may not be distributed to any online platforms by the customer. All Video Readings are meant for private use and viewing only.

6. Collection, storage and processing of personal data

In connection with the conclusion and implementation of the contract, the Tarot Reader collects and stores the following data/information from the customer and/or the person(s): name, first name, email address. The data/information will be used by the Tarot Reader exclusively within the framework and for the purpose of fulfilling the contract and will under no circumstances be passed on to third parties unless the customer requests data transfer in accordance with Section 20 of the GDPR. Upon request, the Tarot Reader will provide the participant with information about their stored data at any time. In addition, the Tarot Reader will immediately correct, block or delete incorrect personal data at the customer's request, unless this is contrary to a statutory retention requirement. After the contract has been fully processed, the data will be blocked and deleted after the relevant legal deadlines have expired, unless the customer expressly does so has agreed to further use. The customer is entitled at any time to object to the collection, storage and use of their personal data/information and/or to revoke their consent – in whole or in part. This requires sending an email to: [email protected]. However, since such a revocation/objection makes fulfillment of the contract impossible, the Tarot Reader is in return entitled, at her own discretion, to terminate the contract for good cause in accordance with Section 6 of these General Terms and Conditions. All details beyond the above regulations are governed by the Tarot Readers data protection declaration, which can be viewed on her website (Privacy Policy). By concluding the contract, the customer confirms that they have read the complete Data Privacy Policy.

7. Withdrawal Policy

The customer is entitled to revoke the contract within 72 hours of its conclusion without giving reasons by means of a clear statement, provided that they are a customer. The revocation can be sent to the Tarot Reader by email to [email protected]. The cancellation deadline is met if the customer sends the cancellation in good time before the deadline expires. In the event of revocation, the Tarot Reader will reimburse the customer for the payments made so far immediately and at the latest within fourteen days of receipt of the revocation. Repayment will be made using the same payment method that the customer used to pay, unless expressly agreed otherwise. In any case, the customer must pay for services already provided by the Tarot Reader during the cancellation period to the extent that corresponds to the contractually agreed overall service.The right of withdrawal expires prematurely if the Tarot Reader has completed her service or has only begun to carry out the service after the customer has given his express consent and at the same time declared his knowledge of the expiry of the right of withdrawal. Withdrawal or a refund will not be permitted or possible once the customer has already recieved the download link for the video of the reading per email.

8. Final provisions

Changes or additions to the contract or these terms and conditions must always be made in writing. Unilateral changes or additions by the customer are invalid. German law is exclusively applicable to the contract between the customer and the Tarot Reader. The exclusive place of jurisdiction for all disputes arising from the concluded contract is Mülheim an der Ruhr. If a contractual partner meets the requirements of Section 38 Paragraph 1 ZPO and does not have a general place of jurisdiction in Germany, the place of jurisdiction is also Mülheim an der Ruhr. Should individual provisions of these general terms and conditions or the contract concluded between the parties be or become wholly or partially ineffective or void, this will not affect the effectiveness of the remaining provisions.
